James Marshall is a leading practitioner with more than 37 years’ experience in Intellectual Property, having qualified as a barrister in 1986 and subsequently requalifying as a solicitor following barristers’ pupillage in a top set of IP Chambers. He is recognised as one of the UK’s leading patent litigators, representing clients from a range of industries in precedent-setting litigations. Marshall’s focus in recent years has been more on patent litigation, particularly in the telecommunications, life sciences, and pharmaceutical fields. He is very experienced in FRAND disputes. His expertise extends to patent and other IP licensing as well as misuse of confidential information, and IP licence disputes. James Marshall has been ranked in directories since Chambers and Partners 1995 and is currently ranked as Band 2 for Patent Litigation.   
 
Marshall is recommended for his expertise in the many aspects of patent litigation and enforcement strategy. He has significant experience in hi-tech and telecommunications patent disputes and frequently acts for household names in the sector in precedent-setting litigations. During his career, he has advised on a number of high-profile cases such as Lilly Icos v. Pfizer, regarding a patent for an erectile dysfunction drug; Generics v. Lundbeck over anti-depressant citalopram, reaching the Supreme Court and then the House of Lords; the important Huawei v. Unwired Planet dispute; and Apple v. Ericsson. James has led for Ericsson in multiple disputes in the last 12 years, including as a co-litigant at the Supreme Court. He has also led for OPPO in 3 major pieces of litigation and before then for ASUSTek SEP litigation brought by Philips.
